Identify conditional language
Look for conditional delivery, bailment, rescission or seller’s-right-to-cancel forms. Ask whether the retail installment contract is final and funded.
Ask the direct question. Request written confirmation of whether financing is final and identify the lender expected to hold the contract. Mark any condition allowing the dealer to demand a return or offer replacement terms.
Keep the old vehicle position clear
If trading a vehicle, ask when title is transferred, the old loan is paid and the trade can be sold. Delay creates problems if financing changes.
Protect the trade and deposit. Record where the trade vehicle, title and deposit remain during conditional delivery. Read the process for returning both sides of the transaction if the original financing does not close.
Do not accept verbal urgency
A later request for a higher rate, larger down payment or cosigner is a new decision. Request the original and proposed terms in writing and take time to compare.
Do not compare only the new payment. If called back, compare the entire replacement contract with the signed version. Rate, term, down payment, products and price can move together, so preserve the original documents and be ready to decline.
Protect the return
If the transaction unwinds, document vehicle condition, mileage, keys, deposit, trade-in and any fees. Do not sign a replacement merely to recover property without reading it.
Escalate documented problems
Keep every contract and message. Depending on the facts and location, a consumer lawyer, attorney general, motor-vehicle regulator or financing regulator may be appropriate.
Find out whether the financing is final before leaving
Possession of the car does not always mean the credit contract has been accepted by a lender. The documents should explain assignment, approval conditions and what happens if funding fails.

Build the deadline file
Timing rights fail when the date, notice rule and delivery proof live in different places. Put them in one working file and calculate backward from the controlling event.
For this decision, the first working threshold is concrete: Conditional forms identified; Funding status confirmed; Trade disposition timing known.
Read those checks beside the sections on Identify conditional language, Keep the old vehicle position clear, Do not accept verbal urgency. Completing one item does not cure a mismatch elsewhere, so leave the decision open until the record is internally consistent.
Assign every unresolved row an owner and a date for receiving the missing document so it cannot disappear in the rush to sign.
| Timing control | Record to preserve | Written confirmation |
|---|---|---|
| Conditional forms identified | Keep the dated inspection, photographs, written findings and any repair estimate or promised remedy. | Is financing approved by the named lender? |
| Funding status confirmed | Mark the controlling page or source, its version date, the responsible party and any exception that changes the result. | Can the dealer cancel after delivery? |
| Trade disposition timing known | Mark the controlling page or source, its version date, the responsible party and any exception that changes the result. | What happens to my trade during that period? |
| Deposit refund terms written | Record the exact date, lead time, delivery rule and proof that notice was sent or received. | What exact terms change if funding fails? |
| Return process documented | Mark the page and version, obtain every referenced attachment and preserve the complete final package. | Is financing approved by the named lender? |
| No blank replacement signed | Mark the page and version, obtain every referenced attachment and preserve the complete final package. | Can the dealer cancel after delivery? |
Calendar an earlier personal deadline when delivery or processing time matters. Keep the notice and proof together instead of relying on a sent-message screen alone.
